A tree surgeon is a highly trained professional involved in the care and maintenance of trees. Tree surgeons – also known as “arborists” – perform a wide variety of tasks related to tree care including but not limited to tree pruning, stump removal, tree removal, tree planting, tree relocating and more. They are also called upon to perform tree risk assessments, to diagnose and treat tree diseases and infestations and to offer their expert opinion in cases where developers and trees come into conflict.
Something we hear quite often is that there is no law prohibiting a property owner from picking up a chainsaw and doing what they want with their trees. In fact, there very well may be numerous laws that prohibit a particular landowner from doing just that. Remember, the UK has some of the world’s most comprehensive tree protection laws so it is safe to assume that you cannot simply move, cut back or fell a tree without getting permission. Of course. In a typical situation, our work will produce a fair amount of waste that we then dispose of in accordance with government safe disposal laws. If there are, work will likely need to be postponed, except in emergency situations where a dead or damaged tree poses a danger to people and property.
You have the legal right to cut back a neighbour’s tree if it is overhanging your property. However, there are several things to consider first. If the tree is under a Tree Protection Order (TPO) you will need to get planning permission. The same is true if the tree is in a conservation area. In addition, no work is allowed that might cause harm to the tree in question. There is also the issue of maintaining good relations with your neighbours. For that reason, we would strongly advise that you discuss the matter with your neighbour before doing anything to the tree.
